Section 78 Appeal by Ellis Machinery against the failure of Stratford on Avon District Council to determine the outline planning application for 6 self-build dwellings, vehicular access, landscaping, all matters reserve except for layout and access off Kineton Road.

The Applicant has appealed to the Planning Inspectorate for the non-determination of the outline planning application for 6 self-build dwellings, vehicular access, landscaping, with all matters reserve except for layout and access off Kineton Road (Planning ref. 22/03574/OUT).

The Applicant amended the scheme and submitted revised plans to the Council on the 16th March 2023. The amendments reflect minor changes to the plans to address comments raised by the Council and are set out below.

  • Plots 1, 2, and 3: Building Height reduced from 10m to 9m (Plots 5 and 6 remain at 6m – bungalows)
  • Plot 4: storey height reduced from 2 to 1.5, building height from 10m to 8m
  • Plot 4: developable area set further back into the plot to reduce impact on the adjacent barn conversion

The Appellant is making a request to the Planning Inspectorate for the decision to be made on the basis of the submitted amended plans. It will be a matter for the Planning Inspector to decide whether the requested amendments to the scheme are accepted.
